Trashie Rewards Program Agreement
The Trashie Rewards Program Agreement (the “Agreement”) is offered by For Days, Inc. DBA Trashie (“Trashie”) via the Trashie website at https://trashie.io and the Trashie browser extension (collectively, the “Services”). This Agreement is a contract between you and Trashie and governs your access to and use of the TrashieCash rewards program (“Rewards Program”). This Agreement is in addition to and supplements the other terms and conditions that govern your use of the Services. Capitalized terms used but not defined in this Agreement have the meaning given to them in our other policies (e.g., Terms of Service, Privacy Notice).
1. Eligibility for the Rewards Program and Acceptance of Terms
By using, participating in, or receiving any benefit of any portion of the Rewards Program, you agree to be bound by this Agreement. To participate in the Rewards Program, you must have a valid account with Trashie or For Days at https://fordays.com (“For Days Site”) and be in good standing. You must be an individual, a resident of the United States or one of its territories, and be at least 18 years old to use or participate in the Rewards Program. You may not use the Rewards Program or accept this Agreement if you are not of legal age and able and competent to form a binding contract with Trashie. The Rewards Program is available only within the United States and its territories, and participation in the Rewards Program is unauthorized in any jurisdiction where it or any portion of this program may violate any legal requirements.
The Rewards Program is for personal, non-commercial use only. You agree that you are not using (and will not use) the Rewards Program for or on behalf of any third party, for any company, association, or group, or for any commercial purpose. You agree that Trashie’s decisions regarding the Rewards Program and your participation in it are final and binding and you agree to abide by all such decisions. Trashie will be the sole arbiter in cases of suspected abuse, fraud, or violation of its rules and any decision it makes relating to termination, suspension, or disabling of your participation in the Rewards Program and/or your forfeiture of any Rewards or other Rewards Program benefits.
2. Rewards Program Description
The Rewards Program allows participants to earn TrashieCash (“Rewards”) by making certain eligible purchases on our Site, Partner Sites, or through Merchant Sites (defined below), and redeeming the Rewards through our Site or certain affiliated sites through qualifying purchases. All Rewards earned or redeemed are tracked and displayed on your Account dashboard (the “Scoreboard").
3. Earning Rewards
As part of our Rewards Program, you may purchase a Take Back Bag which you may fill with clothing, and/or a Take Bax Box which you may fill with electronics, to send back to us for recycling, and in so doing, earn Rewards associated with your Account. The Take Back Bags and Take Back Boxes may be purchased through our Site or through websites with our partners (“Partner Sites”). If you choose to purchase a Take Back Bag or Take Back Box on a Partner Site, you may also earn Rewards points that may be redeemed as described below. We provide certain customer data to our Partners as described in our Privacy Notice.
You may also earn Rewards by making eligible purchases with other affiliated merchants (“Merchants”) on their websites (“Merchant Sites”) using our browser extension and affiliate links (“Links”). The Merchant Sites will display via the browser extension the Rewards earned on each such purchase. Links may be embedded within browsers or other forms of digital communications and may redirect you or direct recipients, with whom you share the Link, to one or more Merchants. Links are configured to track and attribute transactions to you so that you may earn a Reward if you or someone to whom you send a Link completes a transaction with a Merchant. You must follow the links and instructions as disclosed on the Merchant Site or browser extension or other Rewards Program materials provided to you, to complete the eligible purchase and/or complete any other qualifying or required action(s). The Reward earned through a Link with Merchants is calculated as a percentage of your total purchase spend using a Link with the associated Merchant, and is accrued to your Trashie account as TrashieCash.
Some transactions may not earn Rewards or may earn at a rate which is different from the rate indicated by the Merchant, for various reasons. Even if the Merchant indicates that a transaction is eligible or confirmed, transactions may not earn Rewards for several reasons, without notice to you, including without limitation:
(a) Merchants may alter terms, conditions, or commission rates at any time;
(b) Merchants may discontinue their programs;
(c) Merchants may exclude certain products from Reward eligibility at any time;
(d) Merchants may have technical failures which result in transactions failing to be tracked or attributed to you;
(e) Links may fail to function properly;
(f) Link tracking may cease to function during transmission when you share it with others;
(g) Links may be altered or disabled by web browsers or ad blockers;
(h) Merchants may reject transactions due to suspected policy violations;
(i) the communication channel or browser through which the Link is activated or shared may modify or block the Link, alter the tracking code, or strip out the tracking code.
You agree not to edit, remove or modify any element contained in a Link, as changing the Link may invalidate it or cause it to be inoperable. Certain communication platforms may block, alter or otherwise disable a Link, in which case the tracking and attribution may be inoperable, in which case no Reward will be earned. Some Merchants may place cookies (or other forms of tracking beacons) on your device to recognize your device during a subsequent visit. This may enable the sender of the Link to earn a Reward for transactions which occur after the initial click on a Link. If you, or those clicking on your shared Link, block or delete cookies, tracking and attribution may be inoperable, and no Reward will be earned. We reserve the right, without notice to you, to add or remove Merchants, change commission rates from Merchants, and determine to which Merchant we direct a Link.
Some Rewards originate from marketing fees paid by a Merchant to us. Merchants may have holdback periods during which they hold a pending payment for a specified period, for example, until the expiration of a return policy and/or until a service is consumed. If we are not paid for a transaction by a Merchant, we shall have no obligation to provide any Reward to you for the associated transaction. We only provide a Reward to you after a transaction is successfully tracked and completed and after we receive payment for that specific transaction from the Merchant, which can take up to 180 days. If, for any reason or no reason, the Merchant pays less than expected amount or does not pay a commission for the transaction, we reserve the right, in our sole discretion, to adjust or cancel the Reward. Once the merchant confirms eligibility, which can take up to 180 days, the Rewards is confirmed and credited to the customer.
We may be required to nullify Rewards due to limitations established by certain Merchants which prohibit payments to users who reside in certain geographies due to tax nexus or other considerations. In order to prevent fraudulent use of the Services, we may attempt to contact you in order to validate your account and determine whether you are performing acceptable promotional methods. Any Reward amount which may be due to you is determined by us in our sole discretion.
Rewards remain in a pending state until we receive payment from the Merchant for the associated transaction. After we receive payment from a Merchant for your specific transaction Reward, the Reward status may change from pending to confirmed. Rewards Payments may be issued in batches (for example once monthly).
We may at times also offer coupons, discounts or promotions with certain Merchants (“Offers”). We do not guarantee that Merchants will honor Offers. Offer codes may be expired or invalid, and Offers may not be eligible for your transaction, based upon exclusions, terms and conditions determined by Merchants. Offers redeemed by you may result in the Merchant providing a commission to us, subject to you meeting all requirements of the offer.
You agree to promptly and accurately provide all information requested by us or by any of our Merchants such as a payment processor, to validate your identity and to process any payment transactions for you or on your behalf, including any redemption of Rewards. You agree that we have the right, but not the obligation, to seek on your behalf any and all Reward payments from Merchants (defined below). You agree that we have no special relationship with or fiduciary duty to you and you acknowledge that we have no duty to take any action regarding collection of payment from Merchants.
Opportunities to earn Rewards will always be subject to this Agreement and may be subject to additional terms, as specified at the time of the offer, such as terms between you and a Merchant. We may display to you the number of Rewards you may earn in connection with an eligible purchase or rewards offer in any of the following ways: (1) a fixed percentage reward rate (such as 2% in Rewards based on the subtotal of eligible items), (2) a fixed number of Rewards (such as 50 TrashieCash) or (3) a fixed number of Rewards per unit (such as 2 TrashieCash per Take Back Bag) The exact number of Rewards that can be earned in any scenario will be assigned by us based on the prevailing rewards rate displayed to you at the time you are presented with an eligible offer or make an eligible purchase. You can only earn Rewards on eligible purchases or items, and certain items, product categories, and purchases are ineligible for our Rewards Program, with exclusions varying by Merchant. If we are unable to track your transaction/action or if the relevant Merchant does not fulfill its obligation, then we may choose not to provide the Rewards associated with that transaction to you.
4. Redeeming Rewards
Provided your Account is in good standing, you can redeem Rewards in several ways, described below. Available redemption methods and the number of Rewards required for each redemption type are described on our Site and our affiliated site, https://fordays.com. Redemption types may vary, may be subject to availability or limitations, and may be subject to additional redemption-specific terms or limitations. All redemptions are final. We may place additional limitations on your ability to redeem Rewards, such as changing the amount of Rewards required, redemption-rate or availability of any item for which you may redeem Rewards, in our sole discretion and without prior notice. We may also offer additional redemption options from time to time and as described herein.
We may permit you in our sole discretion to apply Rewards points during the checkout process when paying for a purchase on the For Days Site and through other Merchant Sites that allow for Rewards redemption. Where available, you may redeem Rewards toward the total price of an eligible purchase, up to 50% of the purchase price.
To initiate redemption through our For Days Site or a Merchant Site, you will need to log into your Account to access your Scoreboard, where you can claim your Rewards and review additional Merchant terms that may apply. By claiming a Reward, you are agreeing to any additional Merchant terms that apply, and your Reward will be converted to a coupon code or Link through our browser extension, for which we may receive commission. You may apply the coupon code or Link to the applicable Merchant Site for purchases. Upon purchase and coupon code or Link application, the Rewards will be converted to a discount to fund the purchase, and the redemption value of each Reward will be specified by us during the checkout process. Redemption of Rewards at checkout can only be used for eligible purchases from our Site in US Dollars up to a limit we may set in our sole discretion. We do not allow Rewards to be applied to For Days gift cards or Take Back Bags. After purchase, your Scoreboard will be adjusted to reflect your new Rewards balance.
Rewards may not be redeemed for cash and we do not offer cashback.
5. Activity Requirements and Expiration of TrashieCash
“Qualifying Transaction” Defined.For the purposes of this Agreement, a “Qualifying Transaction” means any transaction or activity by a Rewards Program participant that (i) results in the accrual of TrashieCash under Section 3 of this Agreement, including but not limited to the shipment of a Take Back Bag or Take Back Box that has been successfully scanned and processed, the purchase of eligible products or services through a Merchant Site using a valid link or extension, or completion of any other activity authorized by Trashie that is clearly identified as eligible for TrashieCash rewards; and (ii) is not later canceled, returned, reversed, or otherwise rescinded such that the corresponding TrashieCash would be deducted from the participant’s account.
Nature of TrashieCash.
TrashieCash is a promotional loyalty reward issued by Trashie at its discretion. TrashieCash has no cash value, is not a gift card, gift certificate, or stored value instrument under any applicable law, and does not constitute the property of any participant. TrashieCash may not be redeemed for cash, transferred for value, or treated as a financial asset.
Maintenance of Balance; Inactivity Forfeiture.To maintain a balance of TrashieCash in your account, you must complete at least one Qualifying Transaction during each rolling 18-month period (the “Measurement Period”). If, as of the end of a Measurement Period, you have not completed a Qualifying Transaction, you will receive a notice of Pending Forfeiture. Trashie will use commercially reasonable efforts to send you at least one (1) reminder to the email address associated with your Account no fewer than thirty (30) days before any pending forfeiture of your TrashieCash balance under this Section. Failure to provide such notice, or your failure to receive such notice, shall not affect the validity of the forfeiture or give rise to any claim against Trashie.
Transition for Existing Balances.
Transition for Existing Balances. If you hold a TrashieCash balance as of the effective date of this Section and have not completed a Qualifying Transaction during the eighteen (18) month period immediately preceding such effective date, Trashie will send you a notice of pending forfeiture in accordance with this Section promptly following the effective date. Your TrashieCash balance will be forfeited thirty (30) days after such notice is sent unless you complete a Qualifying Transaction during that thirty (30) day period.
Trashie’s Rights.
Trashie reserves the right to determine, in its discretion, whether a transaction qualifies as a Qualifying Transaction, to modify the Measurement Period, to implement additional activity requirements, and to enforce forfeitures consistent with this Agreement. Any material modification to the Measurement Period will be communicated in accordance with Section 7 of this Agreement. Trashie may also adopt separate activity requirements or retention conditions for special promotions, provided that such conditions shall be communicated clearly at the time the offer is made.
6. Rewards Linking with For Days
Any rewards earned on your account with For Days as Closet Cash will be made available as equivalent TrashieCash for you to use in our Rewards Program. Rewards points from your For Days account will be combined into one cumulative point balance for purposes of earning and redeeming Rewards in our Rewards Program, although redemption options may differ depending on whether you choose to redeem your Rewards through the Trashie Site or For Days Site.

7. Amendments to this Agreement
Trashie may amend this Agreement or other terms or policies governing your participation in the Rewards Program from time to time. We will notify you of any changes to this Agreement in accordance with Section 14 of the Terms of Service. The updated Agreement will take effect when posted or as otherwise expressly indicated. If you do not agree to the changes, you must stop participating in the Rewards Program or using any benefits of the Rewards Program. By continuing to use the Rewards Program after any changes to this Agreement take effect or taking such other action as specified by us, you agree to be bound by those changes.
